3. Account Registration

To use our Services, you must:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be at least 18 years old and have legal capacity to enter contracts
• Represent a legitimate business entity

You are responsible for all activities that occur under your account.

4. Subscription and Billing

4.1 Subscription Plans

We offer various subscription tiers with different features and pricing. Current plans include:

• Starter: $97/month (50 calls/month, basic features)
• Professional: $3,500/month (unlimited calls, full features)
• Enterprise: Custom pricing (white-label, dedicated support)

4.2 Payment Terms

• Subscriptions are billed monthly in advance
• All payments are processed securely through Stripe
• Prices are in USD and exclude applicable taxes
• You authorize us to charge your payment method automatically

4.3 Refund Policy

We offer a 30-day money-back guarantee for new customers. To request a refund:

• Contact us within 30 days of your initial purchase
• Refunds are processed within 5-10 business days
• No refunds for renewals or after 30 days
• Refunds do not apply to setup fees or custom development

5. Acceptable Use Policy

You agree NOT to use our Services to:

• Violate any laws, regulations, or third-party rights
• Send spam, unsolicited communications, or illegal content
• Harass, threaten, or impersonate others
• Distribute malware, viruses, or harmful code
• Interfere with or disrupt our Services or servers

• Use our Services for any fraudulent or deceptive practices

Violation of this policy may result in immediate termination of your account without refund.

All content, features, and functionality of our Services are owned by NoShortsNoLosses LLC and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to:

• Use our Services in accordance with these Terms

8. Data Ownership and Usage

Your Data: You retain ownership of all data you input into our Services (contacts, messages, call recordings).

Our Rights: We may use aggregated, anonymized data for analytics, research, and service improvement.

Data Backup: You are responsible for maintaining backups of your data. We are not liable for data loss.

9. Service Availability and Support

We strive to provide 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance with or without notice.

Support is provided via email ([email protected]) and phone (661-543-1141) during business hours. Enterprise customers receive priority support.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOSHORTSNOLOSSES LLC SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Damages resulting from your use or inability to use our Services
• Damages caused by third-party services or integrations

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless NoShortsNoLosses LLC from any claims, damages, losses, or expenses (including legal fees) arising from your use of our Services, violation of these Terms, or infringement of any third-party rights.

12. Termination

By You: You may cancel your subscription at any time through your account dashboard or by contacting support.

By Us: We may suspend or terminate your account immediately if you violate these Terms or engage in fraudulent activity.

Upon termination, you will lose access to our Services and your data may be deleted after 30 days.

13. Dispute Resolution

Governing Law: These Terms are governed by the laws of the State of California, USA.

Arbitration: Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

Class Action Waiver: You agree to resolve disputes individually and waive the right to participate in class actions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email. Continued use of our Services after changes constitutes acceptance of the updated Terms.
